OSHA Fines Alabama Contractor $257,707 After Fatal Sewer Gas Exposure Incident

OSHA has proposed a fine of $257,707 against Construction Labor Services, an Alabama-based contractor, following an investigation into a deadly sewer gas incident that resulted in the deaths of two workers. The incident occurred on August 11, 2025, in Mobile, Alabama, when three workers were installing and repairing sewer lines inside a manhole and were overcome by sewer gases. One worker managed to self-rescue, but Garrett Robertson, 31, and Herber Rivas, 50, died from exposure. OSHA's investigation revealed the company lacked proper confined space entry procedures, training, and emergency response plans, contributing to the fatalities. OSHA also identified 16 serious violations during the six-month investigation. The company has a chance to contest the findings before the penalties become final. The incident is also relevant to a wrongful-death lawsuit filed by the families of the victims, with the lawyer stating that OSHA’s findings lend credence to the allegations of negligence and unsafe work conditions at the site.
